Haryana Lifts Ban on Four Storey Buildings, Neighbour Consent Required

Haryana: In cities, the fourth floor can now be built in sectors and colonies. However, this will have to be agreed with the neighbours. If the neighbour does not agree, he can build four floors by leaving six feet of land on his side. However, in this situation, the neighbour will also not be allowed to build the fourth floor.
The Haryana government has lifted the conditional ban on construction of four storey buildings with stilt parking in the licensed colonies of Haryana Urban Development Authority and Town and Planning Department. In old sectors and colonies, four storey buildings can be constructed only where roads are wider than 10 metres. In Deendayal Upadhyay’s colonies and new sectors, the permission of the neighbour will not be required for this.
During the time of the Manohar government, at the beginning of last year, the building was approved to increase the two and a half floors to first three and then four floors with stilt parking. People from several cities of the state lodged objections to the four-storey construction, after which the government formed an expert committee headed by retired IAS P Raghavendra Rao.
Also, on February 21 last year, the construction of stilt plus four buildings was banned. Now the expert committee in its report has approved the construction of four storeys in sectors and colonies with conditions.
Urban and Planning Minister JP Dalal, while sharing the new policy with reporters on Tuesday, said that in the old colonies where the provision of sewerage, water and electricity etc. will be according to 18 people living in four storey houses, the construction of four-storey buildings will be approved. Basements can be built in plots of 250 square yards or more in old sectors and colonies. Basement will not be allowed in plots of less than this size.
Giving details of the policy along with Additional Chief Secretary Arun Kumar Gupta and Director Amit Khatri, Dalal said there would be no bar on construction of four storey buildings with stilt parking in colonies developed under the Deendayal Upadhyaya Yojana in cities. In such colonies, four storeys can also be constructed on roads of nine metres width.
Not only this in these colonies, the government has also removed the conditions of the fixed plot size for the basement. In the colonies of Deendayal Upadhyaya Yojana, there are plots of 90 to 180 square yards. All plot holders in these colonies will be able to construct basements if they want.
Apart from the licensed colonies of HSVP and Town and Country Planning Department, urban local bodies and colonies under municipal corporations, municipal councils and municipalities will also be able to construct three or four storey buildings with stilt parking. Permission for the same will be granted by the civic department as per the conditions set by Town and Country Planning. However, separate guidelines will be issued for this.
The government had banned four storey construction with stilt parking on February 21, 2023. Even after this, some people and builders in connivance with the officials of Haryana Urban Development Authority (HUDA) obtained the occupancy certificates. Accordingly, they also built the fourth floor. After this came to notice, last month the department had ordered the demolition of the fourth floors. However, these orders were immediately put on hold after the intervention of Chief Minister Nayab Singh Saini. Now JP Dalal said that the fourth floors will not be demolished. Those who have constructed the fourth floor will be charged some fee. Thereafter, permission was granted.
The Town and Planning Department has also created a portal for the construction of four floors with stilt parking. The complete information of the applicants will be available on this portal. It will also be made public as to which plot holder or builder has taken permission to construct a four storey building with stilt parking. With this, buyers of flats will be able to check on the portal whether the floor they are buying has been approved for construction or not.
